It should be noted that the Joint Drainage Board on its own cannot initiate a petition for the initial public hearing to declare the lower end of Haw Creek as a regulated drain. That action requires a property owner initiated petition. However, the Joint Drainage Board can, on its own initiative, hold an advertised 2nd public hearing to set up a special assessment district to raise funds for the necessary improvements or maintenance once Haw Creek has been declared a regulated drain. Successful acquisition of the state or federal grants would eliminate the need for them to hold a 2nd hearing.
